Privacy Policy – Micscape

Please read this Privacy Policy carefully. By accessing or using the Micscape Application ("the Application"), you acknowledge and consent to the collection, processing, and storage of your personal data as described herein. You cannot use the Application without accepting this Privacy Policy.
1. General Overview & Applicable Law
Micscape ("we," "us," "our") is operated from Ontario, Canada. We are committed to protecting the privacy of our users ("you") in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA, S.C. 2000, c. 5) and other applicable Canadian federal and provincial privacy legislation.
Micscape provides a collaborative music and video sharing platform. Users can create projects, generate AI-driven audio, and share content that can be viewed, overdubbed, or cloned by other community members.
2. Data We Collect and Process
- Account Information: When you sign in via Google or Firebase, we collect your name, email address, and profile picture to provide a personalized experience and facilitate collaborative features.
- User-Generated Content: We store the audio and video recordings you upload, as well as metadata related to your projects (titles, genres, and descriptions).
- AI Generation Prompts: Textual prompts submitted to the AI Music Lab are processed to generate audio. These prompts may be transmitted to our AI service providers (Google Vertex AI and Mureka) solely to fulfill your request. We do not use your personal recordings to train third-party AI models without your explicit, separate consent.
- Subscription Data: We use RevenueCat to manage your subscription status. Your payment information is handled securely by the Google Play Store; we do not store credit card details. We process unique subscriber identifiers to verify your access to Creator or Studio plan features.
- Usage & Diagnostic Data: We collect anonymized usage analytics and crash reports via Firebase Analytics and Firebase Crashlytics. This data includes app events, session duration, device model, and operating system version, and is used solely to improve application stability and performance.
- Log Data: In the event of an error, we may collect log data including your device name, OS version, the time and date of the error, and other diagnostic statistics.
3. Cookies & Web Tracking
The Micscape website (micscape.com) and web application may use cookies and similar tracking technologies to maintain session state and measure site performance. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the website may not function properly without cookies. We do not use third-party advertising cookies on the website.
4. Android Permissions Required
To provide the full Micscape experience, the Application requires the following Android permissions:
- Microphone & Camera: To record audio and video for your music projects.
- Internet Access: To stream media, sync projects to the cloud, and process AI generations.
- Storage Access: To save recordings to your device and import existing media files.
- Notifications: To provide updates on upload progress, video transcoding status, and community interactions.
5. Third-Party Service Providers
We employ specialized third-party services to operate the Application. These providers are given access to your data only to the extent necessary to perform services on our behalf and are contractually obligated not to use it for any other purpose:
- Infrastructure: Amazon Web Services (AWS) for secure file storage and database management; AWS Cognito for identity and access management.
- Authentication & Messaging: Firebase (Google) for secure login, push notifications, analytics, and crash reporting.
- Billing & Entitlements: RevenueCat and Google Play Billing.
- AI Music Generation: Google Vertex AI (Lyria) and Mureka AI.
- Advertising: Google Interactive Media Ads (IMA SDK), served to Hobbyist tier users only.
6. International Data Transfers
Our service providers (including AWS and Google Firebase) operate servers located in the United States and other countries. By using the Application, you consent to the transfer of your information to these jurisdictions, which may have different data protection laws than Canada. We take reasonable steps to ensure that any such transfers are subject to appropriate safeguards consistent with PIPEDA.
7. Collaborative Privacy
When you set a project to "Public" or "Shared," your display name and profile picture will be visible to other Micscape users alongside your content. Other users may use the "Overdub" or "Clone" features to interact with your public recordings. You can manage the visibility of your projects at any time within the project settings.
8. Your Rights Under PIPEDA
Under PIPEDA, you have the right to:
- Access: Request access to the personal information we hold about you.
- Correction: Request that we correct any inaccurate or incomplete personal information.
- Withdrawal of Consent: Withdraw your consent to the collection, use, or disclosure of your personal data at any time, subject to legal or contractual restrictions. Withdrawal may affect your ability to use certain features of the Application.
- Complaint: Lodge a complaint with the Office of the Privacy Commissioner of Canada (OPC) if you believe we have not complied with PIPEDA.
To exercise any of these rights, please contact our Privacy Officer at team@micscape.com. We will respond to your request within 30 days as required by PIPEDA.
9. Data Retention & Account Deletion
We retain your personal information for as long as your account is active or as needed to provide you with our services. Specifically:
- Account Deletion: You may delete your account at any time from within the Application settings. Upon deletion, your profile information and privately stored recordings will be removed from our active systems within 30 days.
- Collaborative Content: Content you have contributed to public or shared collaborative projects may be retained in anonymized or derivative form, as it may form part of a joint work with other users.
- Legal & Billing Records: We may retain certain information for up to 7 years as required for accounting, tax, and legal compliance purposes.
- AI-Generated Tracks: Tracks you have generated and saved are stored in our database and are deleted when you remove them or delete your account.
10. Children's Privacy
Micscape does not knowingly collect personally identifiable information from children under the age of 13. If we discover that a child under 13 has provided us with personal information, we will immediately delete such data from our servers. If you are a parent or guardian and become aware of such data collection, please contact us immediately at team@micscape.com.
11. Data Security
We utilize industry-standard encryption, AWS Cognito for identity management, and security protocols to protect your data in transit and at rest. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you as required by applicable Canadian law.
12. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will notify you of any material changes by posting the updated Policy within the Application and updating the "Effective Date" at the top of this document. Continued use of the Application after such changes constitutes your acceptance of the revised Policy.
